BHP Law Strengthens Court of Protection Health and Welfare Team, Bolstering Regional Expertise

BHP Law is proud to announce the continued growth of its nationally recognised Court of Protection Health and Welfare team, welcoming two exceptional legal professionals whose expertise and passion further strengthen one of the largest and most experienced teams in the North East.

The Court of Protection Health and Welfare team at BHP Law specialises in representing individuals who lack mental capacity, often in complex and sensitive cases involving decisions about residence, care, contact, and medical treatment. The team regularly acts in proceedings under the Mental Capacity Act 2005, including challenges under section 21A to Deprivation of Liberty Safeguards (DoLS), and applications under section 16 for best interests determinations. With a strong reputation for advocacy, compassion, and legal excellence, the team works closely with family members, advocates, Relevant Person’s Representatives, and the Official Solicitor to ensure that the rights and voices of vulnerable individuals are protected.

Joshua Butterwick joins BHP Law as a solicitor, bringing with him a wealth of experience in Court of Protection Health and Welfare matters. Since 2020, Joshua has focused predominantly on representing individuals who lack capacity, developing a reputation for meticulous case preparation and empathetic client care. In December 2023, he achieved Mental Capacity (Welfare) Accreditation and was awarded Accredited Legal Representative (ALR) status — a recognition of his expertise and ability to act independently in complex welfare proceedings. Joshua is regularly appointed by the Court to act in cases involving disputes over care arrangements, residence, and contact, and is known for his tenacious advocacy and commitment to promoting the best interests of those he represents.

Rachael Baker joined the team in February 2025 as a paralegal, following her qualification as a CILEX Paralegal in 2023. With over a decade of legal experience, Rachael brings a strong, practical understanding of the law and a deep commitment to supporting vulnerable individuals. Her work in Court of Protection and Mental Health law is marked by diligence, empathy, and a clear focus on ensuring that clients are treated with dignity and respect throughout the legal process. Rachael assists in a wide range of matters, including section 21A challenges and best interests applications, and plays a vital role in supporting solicitors and clients through every stage of proceedings.
